Royal California Holiday Sweepstakes

THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PLAY IN THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY (EXCLUDING FLORIDA) (COLLECTIVELY, THE "ELIGIBILITY AREA") AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.  DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN, AND A LEGAL RESIDENT OF, THE ELIGIBILITY AREA.

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

 

ENTRY IN THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

 

 

  1. Eligibility: You must be a legal resident of the Eligibility Area and 21 years or older at the time of entry.  Void in Florida and to all Florida residents.  Void in overseas U.S. territories, possessions, commonwealths and military installations, and where prohibited by law.  Employees and agents of Yahoo! Inc. , the California Travel & Tourism Commission (“CTTC”) (Yahoo! Inc. and CTTC are collectively referred to in these rules as “Sponsors”), their respective affiliates, subsidiaries, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsors, collectively referred to as “Promotion Entities”), and the immediate family members and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win.

  2. How To Enter: The Sweepstakes begins at 12:01 AM PT on June 27, 2011 and ends at 11:59 PM PT on July 15, 2011 (the “Entry Period”).  To enter online, visit the Yahoo! Shine page on Facebook, located at http://www.facebook.com/yahooshine (the “Promotion Page”). If you have not done so already, click “like” to become a fan of the Promotion Page.  You will see a tab on the Promotion Page for the Promotion.  Click on the tab, then follow the instructions to fill out the entry form for the Promotion (the “Entry Form”) with all required information.  In addition, you will be asked to write a brief submission answering the question “Why three days in California is not enough.” The content and length of your submission will not be considered for purposes of your entry in this Sweepstakes. When you have completed the Entry Form, click the button where indicated to submit your entry.

    For purposes of these Official Rules, “receipt” of an entry occurs when: the Promotion Entities’ servers record: (a) your Facebook account becoming a fan of the Promotion Page during or before the Entry Period, and (b) your entry information on the Entry Form before the close of the Entry Period.  The servers and clock of Yahoo! Inc. are the official record-keepers in connection with this Promotion.      In the event of a dispute regarding the identity of an entrant, the dispute will be resolved in favor of the individual who is the "authorized email account holder" of the email address submitted with the entry.  “Authorized email account holder" is defined as the natural person assigned an email address by an internet access provider, online service provider, or other organization (i.e., business, educational institution) responsible for assigning email addresses for the domain associated with the submitted email address.  A potential prize winner may be required to provide Promotion Entities with proof that he/she is the authorized email account holder associated with the winning entry. 

    LIMIT ONE ENTRY PER PERSON.  Although subsequent attempts to enter may be received, only the first entry received from a particular individual will count; subsequent attempts to enter will be disqualified.  The submission of an entry is solely the responsibility of the entrant.  Entries may only be made according to the method described above.  Proof of sending (such as an automated computer receipt confirming delivery of email, "thanks for entering" message or post office receipt) does not constitute proof of actual receipt by Sponsors of an entry for purposes of these Official Rules.  Automated entries (including but not limited to entries submitted     using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified.  Only eligible entries actually received by Promotion Entities before the end of the specified entry period will be included in the prize drawing.  Illegible, unintelligible, incomplete, garbled, or mutilated entries will be disqualified.  All entries become the property of Sponsors, and none will be acknowledged or returned.

  3. Conduct: By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules.  The Official Rules will be posted at the Promotion Page throughout the Sweepstakes.  Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.  Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects.  Sponsors reserve the right at their sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor or Facebook website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

  4. Prizes:  Five prize winners will each receive a “California Wonder Experience Aboard Mauiva AirCruise” prize package for four persons (winner and three companions) between September 12-19, 2011 (each, a “Prize”).  Trip includes round trip coach class air transportation for four from a major U.S. airport close to winner’s home (carrier and airport to be selected by Sponsors) to Los Angeles, CA, followed by a number of city-to-city air trips to visit different cities in California over the course of an eight day/seven night trip.  Specific itinerary details are at Sponsors’ discretion and will be provided to the winner at time of Prize fulfillment.  Approximate retail value of each Prize: $11,000 (Prize value may vary depending upon the actual cost of air transportation from point of departure and accommodations at time of reservation).

    Approximate retail value of all Prizes: $55,000.  Limit one prize per winner. Except as specifically provided herein, Prize packages do not include taxes, insurance, telephone charges, personal expenses, travel arrangements between winner’s or companions’ homes and U.S. airport of departure, ground transportation, gratuities, passenger facility charges (PFCs), departure taxes, incidental charges, or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the prize winner.  Events offered in connection with the Prize package are subject to change and/or cancellation.  Each winner must be able to travel between September 12-19, 2011, inclusive.  If Promotion Entities cannot find a sufficient number of winners who are able to travel on required dates in time to satisfy verification procedures, not all Prizes will be awarded.  Each winner and his/her respective travel companions must agree to CTTC’s Terms and Conditions.  Once confirmed, trip dates and travel accommodations cannot be changed by winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond Promotion Entities’ control.  Each winner and his/her travel companions must travel on the same dates, itinerary, and fare class.  All travel awarded in this Sweepstakes must be completed by September 19, 2011.  No extensions will be permitted, and any unused travel will be forfeited.  Prizes cannot be used in conjunction with any other promotion or offer and may not be separated.  All tickets issued in conjunction with the Prizes are not eligible for frequent flyer miles, and no code-share flights may be used.  Prizes may not be transferred or assigned except by Sponsors.  Only listed Prizes will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Sponsors reserve the right to substitute any Prize package or component thereof with another prize of equal or greater value in the event that the advertised prize or component is not available.  Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner of that prize.  Yahoo! Inc. expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded.  Yahoo! Inc. makes no representations or warranties concerning the appearance, safety or performance of any prize awarded.  Restrictions, conditions, and limitations apply.  Promotion Entities will not replace any lost or stolen prize items.

  5. Winner Selection and Notification: Potential winners will be selected in a random drawing to be held on or about July 20, 2011, from among all eligible entries received.  Odds of winning depend on the number of eligible entries received.  All prize drawings will be conducted by an independent judging organization,  whose decisions are final.  Winners must be 21 years of age at the time of entry to be eligible.  Each travel companion must be at least 18 years of age or  the age of majority in his/her state of legal residence to accompany a winner on the Prize trip, except that a minor may accompany the winner as a travel companion if the winner or one of the other travel companions on the trip is the minor’s parent/legal guardian.to accompany winner on the Prize trip.

    Potential winners will be notified within seven days after drawing date via email, U.S. mail, telephone and/or by overnight courier.  Each Prize winner and his/her respective travel companions (or, in the case of a minor travel companion, the minor’s parent or legal guardian) may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information (such as social security number), that may be required by Promotion Entities, except where prohibited by law.  Except where prohibited by law, potential winners must return all required documents (together with their travel companions’ required documents) within seven days following attempted notification or prize may be forfeited.  Return of any prize/prize notification as undeliverable, or inability of Promotion Entities to contact a potential winner may result in disqualification and selection of an alternate winner by random drawing.  If applicable, winner may be issued an IRS Form 1099 which documents the value of the prize for tax purposes.  Any difference between actual value of a prize and the approximated value of a prize as stated in these Official Rules will not be awarded.

 

6.     General Conditions:  This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. 

By entering, participants: (a) release and hold harmless Promotion Entities, Facebook, Inc. (“Facebook”) and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for or participating in any prize-related activity, and (b) grant to Sponsors the right to use and publish their proper name and state online and in print, or any other media, in connection with the Sweepstakes. 

Except where prohibited by law, a winner’s acceptance of a prize constitutes permission for Promotion Entities to use such winner’s name, address (city and state only), statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Sweepstakes without further compensation, consideration, review or consent.

 

  1. Limitations of Liability: Promotion Entities assume no responsibility for lost, late, misdirected, illegible, or mutilated entries, or for theft, destruction or unauthorized access to, or alteration of, entries.  Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes.  Promotion Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing.  Promotion Entities are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes.  If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promotion Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries received prior to the cancellation.

  2. Privacy: Please note that while the Sweepstakes entry mechanism is available through an application residing on Facebook.com, you are only providing your personal information to Sponsors, as described in these Official Rules, and not to Facebook.  By entering the Sweepstakes, you agree to Yahoo! Inc.’s use of your personal information as described in Yahoo! Inc.’s Privacy Policy, located at http://info.yahoo.com/privacy/us/yahoo/promotions/details.html.  If you have checked the appropriate box on the entry form, the personal information collected from you in this Sweepstakes will be shared with California Travel & Tourism Commission.  For more information about how California Travel & Tourism Commission uses your personal information, please contact them directly, as they are solely responsible for their use of this information. 

  3. Winners List: The names of the prize winners may be obtained after August 31, 2011 and no later than November 30, 2011 by sending a self-addressed stamped envelope to: Royal California Sweepstakes, Winners List Requests, 701 First Avenue, Sunnyvale, CA  94089, attention: Danielle Dodds.
